Golden Visa – Residence Permit in Portugal for Investment Activity

Lamares, Capela & Associados provides all services related to Golden Visa, which is intended for citizens of countries outside the European Union who wish to obtain a residence permit in Portugal and who cumulatively fulfil the following requirements:

  • To enter legally in Portugal, not needing an additional visa;
  • To make an investment in Portugal, which may be in real estate, companies or by capital transfer;
  • To remain in Portugal only for seven days a year, consecutive or not.

Advantages

Golden Visa holders shall be entitled for five years to:

  • Enter and remain in Portugal;
  • Travel to other countries within the Schengen area without needing a visa;
  • Family reunification, allowing the closest kin of the Applicant to benefit from the same advantages conferred to him/her, creating new opportunities in their lives;
  • Simultaneously benefit from the Golden Visa and the Non-Habitual Resident Status (NHR);
  • Access the permanent residence permit in Portugal at the end of the five years; and
  • Portuguese nationality at the end of five years.

Types of Investment

Real Estate Acquisition

  • Acquisition of real estate with a value of 500 thousand euros or more (the value of the investment can be reduced to 400 thousand euros in low density areas); and
  • Acquisition and execution of rehabilitation works of real estate with a value equal or greater than 350 thousand euros (the value of the investment can be reduced to 280 thousand euros in low density areas)

Note: In this type of investment the Applicant may request bank financing to finance the excess part of the investment and monetize it by renting the real estate for commercial housing, tourist or agricultural purposes.

Real estate investment in housing properties, will only be able to obtain the Golden Visa if the referred investment is made in the territories identified on our interactive map or in the autonomous regions of the Azores and Madeira.

 

Job creation

  • Creation of at least 10 jobs (the number can be reduced to 8 jobs in low density areas).

Note: The company may already exist or be incorporated, provided that it is in Portugal or in another State of the European Union and that it has a permanent establishment in Portugal.

Transfer of Capital

  • Transfer of capital in the amount of 1,5 million euros or more;
  • Transfer of capital in the amount of 500 thousand euros or more for the acquisition of shares of investment funds or venture capital;
  • Transfer of capital in the amount of 500 thousand euros or more for scientific research activities (the value of the investment can be reduced to 400 thousand euros in low density areas); and
  • Transfer of capital in the amount of 250 thousand euros or more to be applied in artistic production activities or recovery/rehabilitation of the Portuguese cultural heritage (the value of the investment can be reduced to 200 thousand euros in low density areas).
  • Transfer of capital in the amount of 500 thousand euros or more to incorporate a commercial company with its head office in Portugal, combined with the creation of five permanent jobs, or to increase the share capital of an already incorporated commercial company with its head office in Portugal, with the creation or maintenance of jobs, with a minimum of five permanent, and for a minimum of three years.

Note: Low density areas are municipalities with less than 100 inhabitants per km2 or with a gross domestic product (GDP) per capita less than 75% of the national average.

Investment period

The Golden Visa requires a total investment period of five years, with an initial duration of one year and renewable for two periods of two years, having to prove the maintenance of the investment and respecting the minimum periods of stay in Portugal.

The Applicant is required to prove compliance with the minimum period of stay in Portugal for:

  • seven consecutive or intercalated days, in the first year;
  • fourteen consecutive or intercalated days, in the subsequent two-year periods.

At the end of the investment period (five years) the holder of the Golden Visa may apply for a permanent residence permit in Portugal and for the Portuguese nationality.
