However, their content is highly relevant for anyone living, investing, or working with migration procedures in Portugal.<\/p>\n<p data-start=\"824\" data-end=\"1174\">\n<h3 data-start=\"824\" data-end=\"1174\">Stricter Criteria for Acquiring Portuguese Nationality<\/h3>\n<p data-start=\"1240\" data-end=\"1372\">One of the central points of the proposals is the reinforcement of the criteria for acquiring Portuguese nationality. In particular:<\/p>\n<ul data-start=\"1374\" data-end=\"2511\">\n<li data-start=\"1374\" data-end=\"1570\">\n<p data-start=\"1376\" data-end=\"1570\">Applicants will be required to demonstrate an <strong data-start=\"1422\" data-end=\"1474\">effective connection to the Portuguese community<\/strong>, defined as \u201cgenuine, strong, and lasting\u201d to apply for nationality by naturalisation.<\/p>\n<\/li>\n<li data-start=\"1572\" data-end=\"1758\">\n<p data-start=\"1574\" data-end=\"1621\">The <strong data-start=\"1578\" data-end=\"1612\">minimum legal residency period<\/strong> will be:<\/p>\n<ul data-start=\"1624\" data-end=\"1758\">\n<li data-start=\"1624\" data-end=\"1705\">\n<p data-start=\"1626\" data-end=\"1705\"><strong data-start=\"1626\" data-end=\"1637\">7 years<\/strong> for citizens of CPLP (Community of Portuguese Language Countries)<\/p>\n<\/li>\n<li data-start=\"1708\" data-end=\"1758\">\n<p data-start=\"1710\" data-end=\"1758\"><strong data-start=\"1710\" data-end=\"1722\">10 years<\/strong> for citizens of all other countries<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"1760\" data-end=\"1954\">\n<p data-start=\"1762\" data-end=\"1954\">Children born in Portugal to foreign parents will <strong data-start=\"1812\" data-end=\"1859\">no longer automatically acquire nationality<\/strong>, unless at least one parent has held legal residence in Portugal for <strong data-start=\"1929\" data-end=\"1953\">at least three years<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1956\" data-end=\"2114\">\n<p data-start=\"1958\" data-end=\"2114\">Naturalisation by descent will be <strong data-start=\"1992\" data-end=\"2026\">limited to great-grandchildren<\/strong>, and the current regime applicable to descendants of Sephardic Jews will be eliminated.<\/p>\n<\/li>\n<li data-start=\"2116\" data-end=\"2280\">\n<p data-start=\"2118\" data-end=\"2280\">An <strong data-start=\"2121\" data-end=\"2141\">integration test<\/strong> will be required, covering knowledge of the Portuguese language, culture, constitutional values, and principles of democratic rule of law.<\/p>\n<\/li>\n<li data-start=\"2282\" data-end=\"2511\">\n<p data-start=\"2284\" data-end=\"2511\">Individuals with prison sentences will be ineligible<strong data-start=\"2336\" data-end=\"2377\">\u00a0for Portuguese nationality<\/strong>. The law will also allow <strong data-start=\"2403\" data-end=\"2426\">loss of nationality<\/strong> in cases of conviction for serious crimes carrying a sentence of five or more years.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2284\" data-end=\"2511\">\n<h3 data-start=\"2284\" data-end=\"2511\">Changes to the Legal Regime for Foreign Nationals and Family Reunification<\/h3>\n<p data-start=\"2597\" data-end=\"2725\">The proposals also include relevant changes to the legal framework for the entry and residence of foreign nationals in Portugal:<\/p>\n<ul data-start=\"2727\" data-end=\"3446\">\n<li data-start=\"2727\" data-end=\"2837\">\n<p data-start=\"2729\" data-end=\"2837\"><strong data-start=\"2729\" data-end=\"2753\">Family reunification<\/strong> will only be permitted <strong data-start=\"2777\" data-end=\"2815\">after two years of legal residence<\/strong> by the main resident.<\/p>\n<\/li>\n<li data-start=\"2839\" data-end=\"3033\">\n<p data-start=\"2841\" data-end=\"3033\">Spouses and adult family members will be required to submit their applications <strong data-start=\"2920\" data-end=\"2952\">from their country of origin<\/strong>, removing the current possibility to request reunification from within Portugal.<\/p>\n<\/li>\n<li data-start=\"3035\" data-end=\"3173\">\n<p data-start=\"3037\" data-end=\"3173\">Applications will be subject to <strong data-start=\"3069\" data-end=\"3092\">stricter assessment<\/strong> of housing conditions, financial means, and integration into Portuguese society.<\/p>\n<\/li>\n<li data-start=\"3175\" data-end=\"3295\">\n<p data-start=\"3177\" data-end=\"3295\">The <strong data-start=\"3181\" data-end=\"3194\">CPLP visa<\/strong>, currently granted under simplified rules, will require <strong data-start=\"3251\" data-end=\"3294\">prior approval from the new Border Unit<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3297\" data-end=\"3446\">\n<p data-start=\"3299\" data-end=\"3446\">The option to apply for a visa <strong data-start=\"3330\" data-end=\"3364\">without an employment contract<\/strong> will be restricted to applicants considered <strong data-start=\"3409\" data-end=\"3446\">\u201chighly qualified professionals.\u201d<\/strong><\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3453\" data-end=\"3501\"><\/h3>\n<h3 data-start=\"3453\" data-end=\"3501\">Creation of a New Foreigners and Borders Unit<\/h3>\n<p data-start=\"3503\" data-end=\"3752\">The Government is also proposing the creation of a new <strong data-start=\"3558\" data-end=\"3589\">Foreigners and Borders Unit<\/strong> within the <strong data-start=\"3601\" data-end=\"3633\">Public Security Police (PSP)<\/strong>. This unit would be responsible for immigration control, monitoring of legal stays, and enforcement of removal orders.<\/p>\n<p data-start=\"3754\" data-end=\"3916\">This structure will assume several responsibilities that previously belonged to <strong data-start=\"3834\" data-end=\"3878\">SEF \u2013 the Foreigners and Borders Service<\/strong>, which is currently being phased out.<\/p>\n<p data-start=\"3754\" data-end=\"3916\">\n<h3 data-start=\"3923\" data-end=\"3985\">Extension of Residence Permits and Visas Until October 2025<\/h3>\n<p data-start=\"3987\" data-end=\"4176\">At the same Council of Ministers meeting, the Government approved the <strong data-start=\"4057\" data-end=\"4175\">automatic extension of the validity of residence permits, visas, and other expired documents until 15 October 2025<\/strong>.<\/p>\n<p data-start=\"4178\" data-end=\"4410\">This measure extends the previous deadline, which was due to expire on 30 June, and aims to ensure stability and continuity in pending procedures, avoiding irregular legal situations during the transition to the new legal framework.<\/p>\n<p data-start=\"4178\" data-end=\"4410\">\n<h3 data-start=\"4178\" data-end=\"4410\">Final Considerations<\/h3>\n<p data-start=\"4442\" data-end=\"4853\">The proposals approved by the Council of Ministers reflect a clear trend toward <strong data-start=\"4522\" data-end=\"4643\">tightening the rules for acquiring Portuguese nationality and for the regularisation of foreign nationals in Portugal<\/strong>.
