{"id":87386,"date":"2025-08-12T09:13:25","date_gmt":"2025-08-12T09:13:25","guid":{"rendered":"https:\/\/lamarescapela.pt\/?p=87386"},"modified":"2025-08-12T14:11:34","modified_gmt":"2025-08-12T14:11:34","slug":"new-nationality-law-portuguese-citizenship-restricted-for-almost-everyone","status":"publish","type":"post","link":"https:\/\/lamarescapela.pt\/en\/knowledge\/new-nationality-law-portuguese-citizenship-restricted-for-almost-everyone\/","title":{"rendered":"New Nationality Law: Portuguese Citizenship Restricted for Almost Everyone"},"content":{"rendered":"<p>The Government has presented a proposal to amend the\u00a0<strong>Nationality Law<\/strong>, with\u00a0<strong>direct impact on virtually all types of processes<\/strong>.<\/p>\n<p>Although media attention is mainly focused on\u00a0<strong>nationality through length of residence<\/strong>, the truth is that\u00a0<strong>grandchildren, great-grandchildren, minor children, spouses, de facto partners, ascendants of original Portuguese nationals<\/strong>, among others,\u00a0<strong>will also be negatively affected<\/strong>.<\/p>\n<p>Following our <a href=\"https:\/\/lamarescapela.pt\/en\/knowledge\/immigration\/the-new-nationality-and-immigration-regime-has-already-been-discussed-in-a-first-phase-what-could-change-now\/\">previous article<\/a>, we will\u00a0<strong>explore the most relevant changes<\/strong>, with a\u00a0<strong>\u201cBefore and After\u201d comparison<\/strong>\u00a0so you can understand, in practical terms,\u00a0<strong>what may change<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Key Proposed Changes with the New Nationality Law<\/strong><\/h3>\n<p><strong>1. Children of Foreigners Born in Portugal<\/strong><\/p>\n<ul>\n<li>Will only be entitled to nationality if\u00a0<strong>the parents have been legally residing for at least 3 years<\/strong>\u00a0at the time of birth.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>2. Grandchildren of Portuguese Nationals<\/strong><\/p>\n<ul>\n<li><strong>Mandatory proof<\/strong> of Portuguese language, culture, rights, duties, and political organization of the State.<\/li>\n<li><strong>General exclusion of applicants<\/strong>\u00a0with\u00a0<strong>effective prison sentences<\/strong>, even if\u00a0<strong>less than 3 years<\/strong>, in processes where this was already foreseen.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>3. Naturalization of Adults<\/strong><\/p>\n<ul>\n<li><strong>Mandatory proof<\/strong> of Portuguese language, culture, rights, duties, and political organization of the State.<\/li>\n<li><strong>Increase in residence period<\/strong>\u00a0from\u00a0<strong>5 to 10 years<\/strong> (7 years for CPLP citizens).<\/li>\n<li><strong>Residence only counts<\/strong>\u00a0from the\u00a0<strong>date of the residence card<\/strong>, not from the date of the first application.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>4. Naturalization of Minors<\/strong><\/p>\n<ul>\n<li>Only with\u00a0<strong>legal residence of the parent for 5 years<\/strong>\u00a0(does not accept illegal or shorter periods).<\/li>\n<li>Additionally,\u00a0<strong>regular attendance of compulsory education in Portugal<\/strong>\u00a0is required.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>5. Naturalization of Great-Grandchildren<\/strong><\/p>\n<ul>\n<li><strong>Direct nationality limited to great-grandchildren<\/strong>; further generations lose the right.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>6. Acquisition through Marriage, De Facto Union or Minor Children<\/strong><\/p>\n<ul>\n<li><strong>Possibility of opposition to nationality<\/strong>, based on\u00a0<strong>naturalization parameters<\/strong>, i.e., proof of Portuguese language, culture, rights, duties, and political organization of the State.<\/li>\n<li>Nationality process for de facto unions only after a court ruling recognizing the union by a Portuguese court.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>7. Elimination of Several Nationality Processes<\/strong><\/p>\n<ul>\n<li>Processes that will no longer exist:\n<ul>\n<li><strong>Sephardic Jews<\/strong><\/li>\n<li><strong>Ascendants of original Portuguese nationals<\/strong><\/li>\n<li><strong>Those who previously had Portuguese nationality and lost it<\/strong>\u00a0(e.g., born in former colonies before independence)<\/li>\n<li><strong>Born in Portugal to undocumented parents<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>8. In all naturalizations, the residence period<\/strong>\u00a0will be counted\u00a0<strong>from the date of the <a href=\"https:\/\/aima.gov.pt\/pt\/viver\/autorizacao-de-residencia-permanente-art-80-o\" target=\"_blank\" rel=\"noopener\">residence card<\/a><\/strong>\u00a0(not from the first application, as before).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>9. sentence having become final, for a crime punishable under Portuguese law, and on there being no danger or threat to national security or defence, namely through involvement in activities related to the practice of terrorism, violent, especially violent or highly organized crime.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Article 9 \u2013 Grounds [for opposing the acquisition of nationality by virtue of will]<\/strong><\/p>\n<p>1 \u2013 The following are grounds for opposing the acquisition of Portuguese nationality by virtue of will:<\/p>\n<p>a) The lack of an effective link to the national community;<\/p>\n<p>b) A conviction with a final and unappealable sentence of imprisonment of three years or more for a crime punishable under Portuguese law;<\/p>\n<p>c) The exercise of public functions not predominantly of a technical nature or the provision of non-compulsory military service to a foreign state;<\/p>\n<p>d) The existence of a danger or threat to national security or defence, namely through involvement in activities related to terrorism, violent, especially violent or highly organized crime.<\/p>\n<p>2 \u2013 Opposition to the acquisition of nationality on the basis of point a) of the previous paragraph does not apply to situations of acquisition of nationality in the case of marriage or de facto union when there are common children of the couple with Portuguese nationality.<\/p>\n<p>3 \u2013 Opposition to the acquisition of nationality on the basis of paragraph 1a) shall also not apply to situations of acquisition of nationality when the marriage or de facto union has been going on for at least six years.<\/p>\n<p>4 \u2013 Proof of the absence of a conviction referred to in paragraph 1 b) shall be subject to the provisions of Article 6, no. 11.<\/p>\n<p><strong>Article 10 \u2013 Procedure [for opposing the acquisition of nationality by virtue of will]<\/strong><\/p>\n<p>1 \u2013 The opposition shall be filed by the Public Prosecutor\u2019s Office within one year of the date of registration of the acquisition of nationality, in proceedings to be instituted under the terms of article 26.<\/p>\n<p>2 \u2013 It shall be compulsory for all authorities to report the facts referred to in the previous article to the Public Prosecutor\u2019s Office.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3930401 e-con-full e-flex adherence to the fundamental principles of the democratic rule of law<\/u>;<\/p>\n<p>f)\u00a0<u>They have not been convicted of a crime punishable under Portuguese law by a final and unappealable court decision<\/u>;<\/p>\n<p>g)\u00a0<u>They do not constitute a danger or threat to national security or defense, namely through involvement in activities related to terrorism, violent, especially violent or highly organized crime<\/u>.<\/p>\n<p>2 \u2013 There is no opposition to the acquisition of Portuguese nationality when the marriage or de facto union is\u00a0<u>more than six years old<\/u>\u00a0or when there are common children of the couple with Portuguese nationality,\u00a0<u>except on the grounds of the material parameters of Article 6, no. 1, f) or g)<\/u>.<\/p>\n<p>f) They have not been convicted of a crime punishable under Portuguese law by a final and unappealable court decision;<\/p>\n<p>g) They do not constitute a danger or threat to national security or defense,
